One component that often comes under scrutiny is alcohol. Essentially, the use of alcohol in production processes has become an integral component due to its multifunctional benefits, such as improving product stability and enhancing the quality of the final result. This phenomenon is also reflected in the cosmetics industry, where alcohol serves as one of the main raw materials to increase product effectiveness. Its utilization can be found in various product variants, from skincare, perfumes, to collagen drinks that are now in demand by various segments of society across generations.

source: personal image

Collagen is produced from various raw materials, one of which is rice wine. It is generally known that rice wine contains alcohol, which raises doubts among consumers regarding its halal status. For example, in Japan, Muslim consumers often experience confusion when choosing collagen products because the composition label lists sake (rice wine) content, albeit in minimal amounts. The presence of alcohol in sake, which is considered haram under Islamic law, becomes the main cause of consumer dissatisfaction in deciding to purchase these products. This article is written to answer questions about whether collagen made from rice wine is halal or not. Before delving deeper into this explanation, let’s discuss the law regarding the use of khamr first!

Khamr is defined as any type of intoxicating drink, whether derived from wine fermentation or other raw materials, and is not limited to specific processing methods, whether through distillation or not. Meanwhile, alcohol refers to the chemical compound ethanol (C₂H₅OH), an organic substance formed from a combination of carbon, hydrogen, and oxygen elements, serving as the active component that causes intoxicating effects in forbidden drinks. Alcoholic beverages that fall into the khamr category are drinks containing alcohol/ethanol (C₂H₅OH) with a minimum content of 0.5%. Alcoholic beverages that fall into the khamr category are considered impure (najis) and are haram (forbidden), whether in small or large amounts.

In Islamic law, alcohol is classified into two legal statuses, namely halal and haram. First, alcohol is deemed haram if used in the production of khamr (alcoholic beverages) that have intoxicating properties. This prohibition is absolute considering that the main purpose of making khamr is to induce the effect of losing consciousness, an action that contradicts the principle of protecting the mind and health as stated in the Quran, Surah Al-Maidah verse 90:

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إِنَّمَا ٱلْخَمْرُ وَٱلْمَيْسِرُ وَٱلْأَنصَابُ وَٱلْأَزْلَٰمُ رِجْسٌ مِّنْ عَمَلِ ٱلشَّيْطَٰنِ فَٱجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ

“O you who believe! Intoxicants (khamr), gambling, (dedication of) stones, and (divination by) arrows are an abomination of Satan’s handwork. So avoid them that you may be successful.”

Second, alcohol can be categorized as halal if used in industrial contexts that produce non-khamr goods, such as pharmaceuticals, cosmetics, or functional chemicals. This permissibility is based on the principles of istihalah (substance transformation) and maslahat mursalah (public interest) in Islamic law, where alcohol functions as a technical component to extract chemical compounds, increase formula stability, or facilitate the sterilization process.

The main condition for the halal status of alcohol is the absence of consumptive purposes that are intoxicating and the certainty that the alcohol does not come from impure sources. Additionally, the use of alcohol in this context must meet the criteria of dharurat (urgent need) or hajat syar’iyyah (shari’a need) recognized by contemporary fiqh authorities. Thus, its legality remains within the corridor of the principle of al-ashl fi al-ashya’ al-ibahah (the principle of permissibility as long as there is no evidence of prohibition), as long as its utilization is in line with the purpose of the well-being of the ummah and does not violate the boundaries of sharia.

source: cnnindonesia.com

According to MUI Fatwa No. 10 of 2018 concerning alcohol in food and beverage products, the law on the use of alcohol/ethanol from non-khamr industries is permissible (mubah), as long as the alcohol meets the following terms and conditions:

Beverages: alcohol contained in them must be from natural fermentation, not using haram ingredients, not intended for intoxication, and not containing more than 0.5% alcohol.

Food: similar to beverages, alcohol contained in food must also be from natural fermentation without any additives. However, in food, the use of alcohol is not limited by percentage.

Intermediate products or products used as additives in food that can still be further processed into other products. For example, cooking spices. These products are also not limited by their alcohol percentage.

Cosmetics and medicine: alcohol contained in the product must be as a solvent or active ingredient. In this case, the use of alcohol is also not limited by percentage, as long as it is not harmful and still in accordance with the dosage.

Collagen is categorized as a therapeutic product or medication, so the alcohol content in it can be considered halal as long as it meets the sharia criteria. This is based on the principle that alcohol in this context functions as a technical supporting material, not as a substance consumed for intoxicating purposes. The main purpose of using collagen is to improve body health and fitness, which is in line with Islamic teachings about the importance of maintaining and caring for the blessings given by Allah SWT. As stated in His word in QS. Al-A’raf verse 31:

“O children of Adam, take your adornment at every place of worship, and eat and drink, but do not be excessive. Indeed, He does not like those who are excessive.”

Thus, Islamic law affirms a universal principle that combines the firmness of halal-haram boundaries with flexibility in accommodating scientific advances. The case of using alcohol in collagen production becomes concrete evidence that sharia is not merely restrictive, but responsive to the context of benefits and sharia purposes.

The halal status of alcohol in this context is not automatically categorized as haram as long as its utilization is instrumental—as a preservative medium or for extraction—and does not lead to intoxication effects. This approach is in line with the concepts of maslahat (public interest) and dharurah (urgent need) in contemporary fiqh, where priorities of health and technological innovation are accommodated without neglecting the principle of submission to divine provisions. Therefore, collaboration between scientists, scholars, and halal certification authorities becomes key to ensuring that modern products such as collagen continue to meet sharia standards while addressing the challenges of the times.

In the end, Islam affirms that scientific advancement and spiritual commitment are not a dichotomy, but two synergistic sides in realizing the holistic welfare of mankind.

References

Muhamad (2021). Kaidah Hukum Asal Terhadap Benda Adalah Boleh.
